Agent Terms of Service

Note: These Agent Terms supplement the
General Terms of Service. By becoming an agent partner on i3nb, you agree to both the General Terms and these Agent-specific Terms.
1. Agent Eligibility
To become an agent partner on i3nb, you must:
- Hold a valid real estate license in your operating jurisdiction
- Be affiliated with a licensed brokerage (where required by law)
- Complete the agent verification process
- Provide proof of professional liability insurance
- Maintain good standing with relevant regulatory bodies
- Complete any required platform training
2. Agent Qualifications
Agents must maintain:
- Active and valid real estate license at all times
- Current professional liability (E&O) insurance
- Compliance with continuing education requirements
- Updated profile information and credentials
- Good standing with applicable real estate boards
3. Commission Structure
Regarding commissions and payments:
- Commission rates are established in individual agent agreements
- Commissions are paid upon successful transaction completion
- i3nb retains a platform fee from each transaction
- Payment schedules follow standard industry practices
- Agents are responsible for their own tax obligations
- Commission disputes will be handled according to platform policies
4. Client Representation
When representing clients, agents must:
- Act in the best interest of their clients at all times
- Provide accurate and honest information about properties
- Disclose any conflicts of interest
- Maintain client confidentiality
- Follow fair housing laws and anti-discrimination policies
- Provide competent and professional service
5. Lead Handling
Regarding platform-generated leads:
- Respond to leads promptly (within 24 hours recommended)
- Track lead status and outcomes in the platform
- Do not share or sell leads to third parties
- Report lead quality issues through proper channels
- Maintain professional communication with all leads
6. Listing Requirements
When creating or managing listings, agents must:
- Ensure all listing information is accurate and up-to-date
- Use only authorized and genuine property photos
- Obtain necessary permissions from property owners
- Comply with MLS rules and regulations
- Update listings promptly when status changes
- Remove sold or unavailable listings
7. Compliance Obligations
Agents must comply with:
- All applicable federal, state, and local real estate laws
- Fair Housing Act and anti-discrimination regulations
- Real Estate Settlement Procedures Act (RESPA)
- Truth in Lending Act (TILA) where applicable
- State-specific real estate regulations
- Platform policies and guidelines
8. Agent-Platform Relationship
Understanding the relationship:
- Agents are independent contractors, not employees
- i3nb does not control agent work methods or schedules
- Agents maintain their own client relationships
- Platform provides tools and leads, not employment
- Agents are responsible for their own business expenses
9. Prohibited Conduct
Agents may not:
- Engage in unlicensed real estate activities
- Discriminate against clients based on protected characteristics
- Circumvent the platform for transactions
- Misrepresent qualifications or experience
- Engage in dual agency without proper disclosure
- Accept undisclosed compensation
- Share login credentials or account access
10. Termination
Agent partnerships may be terminated:
- By either party with written notice
- Immediately for violation of these terms
- Upon license suspension or revocation
- For fraudulent or illegal activity
- For repeated poor performance or complaints
Upon termination, pending transactions will be handled according to platform policies.
